Platform Provider: Try Instant Fit (“Company,” “We,”
“Us,” or “Our”)
Service Covered: tryinstantfit.com Dashboard, APIs,
Virtual Try-On Engine, and Embeddable Client Modules (collectively, the
“Services”)
Audience: Business-to-business users (“Merchant,”
“Client,” “Vendor”) and end-user shoppers (“End User,” “Customer”)
These Terms describe how the platform actually operates and the commercial basis on which we provide it. They have not yet been reviewed by qualified counsel, so their enforceability in any particular jurisdiction is not warranted; we will remove this note once that review is complete.
1. Acceptance of terms & legal binding
By accessing the dashboard, uploading assets, generating passcodes, or initiating a virtual try-on scan via Try Instant Fit, you (“User,” “Merchant,” or “End User”) agree to be bound by these Terms of Service and our Privacy Policy. If you accept these Terms on behalf of a corporate entity, you represent that you have authority to bind that entity. If you do not agree to these Terms in their entirety, you must not access or use the platform.
2. Architecture & service overview
Try Instant Fit provides a SaaS-based AI virtual fitting solution.
- Merchant operations: Merchants upload garment photography, configure catalogue settings, assign access passcodes, set free/open try-on limits, and analyse usage metrics.
- End-User operations: End Users access the service via QR code or web link, optionally or mandatorily submit contact details based on session access type, and upload personal photography to receive an AI-generated virtual fitting preview.
- Scan-gated isolated catalogues: Access to a Merchant’s catalogue is scan-gated. Scanning a Merchant’s QR code or access link grants access exclusively to that Merchant’s catalogue view. We do not aggregate, combine, or cross-display Merchant catalogues into a public marketplace, and we do not grant cross-store browsing.
- Data infrastructure: The platform uses enterprise-grade cloud database providers and encrypted hosting environments whose operators maintain recognised industry security certifications. We may migrate backend data layers to equivalent high-security infrastructure without altering the privacy protections described in our Privacy Policy.
3. Account registration & passcode governance
- Merchant accounts: Merchants are responsible for the confidentiality of their dashboard credentials and for all activity under their account.
- Access passcodes: Merchants may issue custom, count-restricted passcodes to End Users and are solely responsible for distributing them to authorised shoppers. We may terminate passcodes that are publicly leaked, abused, or used for automated or bot testing. Passcode and QR limits are access controls, not security guarantees.
4. Account inactivity & data lifecycle
- Six-month inactivity clause: If a Merchant account shows no log-ins, catalogue updates, passcode generations, or end-user try-on activity for six consecutive months, we may mark the account dormant and proceed with termination.
- Purging of inactive data: On termination for inactivity, we may permanently purge the Merchant’s stored catalogue items, QR code links, lead histories, and passcode configurations.
- Forfeiture of remaining credits: Unused Garment Processing or Customer Fitting Credits on an account terminated for six months of inactivity are non-refundable and are forfeited on account closure.
5. Credit model, payments & international transactions
- Garment Processing Credit: Consumes one credit per product image upload, deducted on submission to trigger AI garment extraction. Text, price, or metadata updates to existing products do not consume credits.
- Customer Fitting Credit: Consumes one credit per try-on generation triggered by an End User, via open try-on or passcode validation.
- Payment infrastructure: Payments and credit package settlements may be made via SWIFT/IBAN bank wire transfer, corporate electronic invoicing, or PCI-DSS compliant third-party payment gateways. Transactions are secured using industry-standard encryption. We may introduce or transition payment gateways, regional clearing partners, or banking channels to optimise cross-border transaction speed and regulatory compliance.
- Taxes, fees & surcharges: All listed prices are exclusive of taxes, bank transfer fees, currency conversion charges, cross-border transaction fees, and gateway surcharges. The Merchant/Customer is solely responsible for all applicable national, regional, local, or international taxes (including VAT, sales tax, GST, withholding taxes, or import levies) and for all bank handling fees, SWIFT wire charges, intermediary bank fees, card processing surcharges, and currency conversion fees. We must receive the full net invoiced amount without deduction for foreign exchange losses or processor fees.
- Minimum order thresholds: To avoid disproportionate cross-border banking fees relative to service volume, we enforce a minimum order value for international purchases and credit packages. International orders that do not meet our minimum bulk credit package criteria will not be processed.
- Vendor image quality requirement: The visual accuracy of the AI-extracted garment depends on the source image supplied by the Merchant. Merchants are responsible for ensuring uploaded product photography is high resolution and sharply focused, clearly and evenly lit, and shot at a proper front-facing, unobstructed angle that exposes the entire garment design.
6. No refunds and no credit replacement
All credit purchases, credit deductions, garment processing actions, and try-on generations are final, non-refundable, and non-restorable. We do not operate a try-on issue-reporting, dispute, or refund-review process, and we do not evaluate, inspect, or adjudicate the visual output of processed garments.
If an AI extraction or try-on yields sub-optimal, distorted, or undesired visual results — including because of poor image lighting, incorrect camera angles, dark environments, obscured garment details, or natural AI processing variation — the consumed credit remains deducted and will not be refunded, replaced, or credited back. We disclaim any obligation to investigate extraction results, review image quality claims, or issue manual credit adjustments. Nothing in this section excludes rights that cannot lawfully be excluded under mandatory consumer law.
7. AI model performance disclaimer
- Processing: Try Instant Fit uses industry-leading multimodal AI vision models engineered to deliver high-quality visual outputs.
- No guarantee of visual perfection: As with all machine learning systems, outputs are generated probabilistically. We do not guarantee visual perfection, exact fabric drape accuracy, precise colour matching, or flaw-free renderings. AI anomalies, edge-case artefacts, complex fabric textures, and minor fitting distortions may occur. Virtual try-on outputs are visual approximations for consumer guidance and estimation only, and do not guarantee fit, measurements, stock, or tailoring outcomes.
8. Intellectual property & brand protection
- Merchant ownership: Merchants retain ownership of all product images, brand assets, logos, trade secrets, and descriptions uploaded to the platform, and grant Try Instant Fit a worldwide, non-exclusive, royalty-free licence to host, process, extract, and display these assets solely to provide the virtual fitting service and catalogue display.
- Customer photographs: End Users retain all rights in photographs they submit. The licence granted to us is limited to processing the image in memory to generate the requested try-on, and ends when the session ends. We do not store, reuse, or train on customer photographs.
- Platform IP: The underlying software, machine learning architectures, UI designs, algorithms, codebases, and trademarks remain the exclusive property of Try Instant Fit. Merchants, competitors, and third parties must not reverse-engineer, decompile, or attempt to extract the weights or source code of the AI try-on engine.
- Anti-scraping: Competitors, rival platforms, or agents acting for competing services must not create merchant accounts, initiate test scans, or scrape UI workflows to analyse, replicate, or benchmark our proprietary technology. Breach may result in immediate account termination and a claim for damages.
9. Prohibited content & system usage
Users and Merchants must not upload imagery containing explicit material, nudity, weapons, hate speech, or illegal content. You may upload only photographs you own or are authorised to use, must not upload images of another person without their consent or of a child without lawful guardian permission, and must not use results for deception, impersonation, harassment, discrimination, or unlawful biometric profiling. Automated scripting, bot testing, and exploitation of API endpoints to bypass credit usage or passcode gates are prohibited.
10. Outbound e-commerce links
The platform may present an optional “Buy Now” link directing End Users to external Merchant storefronts. Try Instant Fit acts strictly as a visual try-on intermediary and is not party to, responsible for, or liable for any transaction, payment processing, fulfilment, dispute, or return occurring on a third-party Merchant website.
11. Availability and changes
The Services may change or be interrupted. We do not promise uninterrupted availability or that every AI result will be suitable. Material changes to these Terms will be posted with an updated effective date.
12. Disclaimers & limitation of liability
- “As is” provision: The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including visual accuracy or fit sizing guarantees.
- Liability cap: To the maximum extent permitted by applicable law, Try Instant Fit is not liable for indirect, incidental, special, or consequential damages, loss of sales, or network vulnerabilities. Our aggregate liability will not exceed the total credit purchase amount paid by the Merchant in the three months preceding the claim. Nothing excludes liability that cannot lawfully be excluded.
13. Termination
You may stop using the Services at any time. We may restrict or terminate accounts for breach, fraud, abuse, non-payment, security risk, or legal obligation. Provisions that logically survive termination remain effective.
14. Electronic records
You consent to electronic contracting, notices, and records. Acceptance time and policy version may be retained as evidence of consent.
15. Governing law & dispute resolution
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules. The courts of Karachi, Pakistan have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.
This clause does not deprive a consumer of the protection of mandatory consumer-law provisions, or of the right to bring proceedings in the courts of their country of residence, where applicable law so requires. Before commencing proceedings, the parties will attempt in good faith to resolve any dispute by negotiation for 30 days following written notice to info@tryinstantfit.com.
